Welcome to TeachGenie! By using our platform, you agree to these Terms of Service. TeachGenie is an independent online marketplace connecting students and tutors. Tutors are not employees or agents of TeachGenie. Please read these terms carefully.
1. Acceptance of Terms
By accessing or using TeachGenie (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
2. Eligibility
- You must be at least 18 years old to create an account, or have a parent/guardian create and manage your account if you are a minor.
- By using the Platform, you represent and warrant that you meet these requirements.
3. Account Registration
- You must provide accurate, complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- Parents/guardians are responsible for all activity on accounts created for minors.
4. Marketplace Nature & Independent Tutors
- TeachGenie is a marketplace; tutors are independent contractors, not employees or agents of TeachGenie.
- TeachGenie does not supervise, direct, or control tutors' work.
- Tutors are solely responsible for the services they provide, including lesson content, scheduling, and communication.
5. Payments & Refunds
- Payments for tutoring sessions are processed through third-party payment providers.
- Refunds, if any, are handled directly by tutors according to their own policies. TeachGenie is not responsible for issuing or enforcing refunds.
6. User Conduct & Safe Space
- You agree to use the Platform in a respectful, lawful manner.
- Harassment, discrimination, hate speech, or illegal activity is strictly prohibited.
- TeachGenie reserves the right to suspend or terminate accounts for violations of these standards.
7. Content & Intellectual Property
- Users may not post or share content that infringes on others' intellectual property rights.
- By posting content on the Platform, you grant TeachGenie a non-exclusive license to use, display, and distribute that content for Platform purposes.
- AI Processing License: By uploading materials to AI-powered features (including but not limited to the Exam Predictor), you grant TeachGenie a worldwide, non-exclusive, royalty-free license to:
- Process, analyze, and use your materials for AI model training and improvement
- Generate AI-powered insights, predictions, and recommendations
- Store and retain your materials for AI analysis and platform enhancement
- Use anonymized and aggregated data for research and development
- Learning Data License: By using the platform's communication and learning features, you grant TeachGenie a worldwide, non-exclusive, royalty-free license to:
- Store and retain messages and communications for platform functionality
- Analyze learning responses and patterns for educational improvement
- Use anonymized learning data for research and platform enhancement
- Provide personalized educational recommendations and content
- Copyright Warranty: You represent and warrant that you own all rights to uploaded materials or have obtained necessary permissions from copyright owners.
- DMCA Compliance: TeachGenie respects copyright laws and will respond to valid DMCA takedown requests as outlined in Section 18.
8. Disclaimers & Limitation of Liability
- TeachGenie does not guarantee the quality, safety, legality, or outcome of tutoring services.
- The Platform is provided "as is" without warranties of any kind.
- TeachGenie is not liable for any damages arising from your use of the Platform or interactions with other users.
- AI Feature Disclaimers:
- AI-powered predictions, recommendations, and insights are estimates only and should not be considered as guaranteed outcomes
- AI analysis accuracy depends on the quality and relevance of uploaded materials
- Users should always consult with qualified instructors for official guidance and assessment
- TeachGenie is not responsible for decisions made based on AI-generated content
- Copyright Risk Disclaimer: Users are solely responsible for ensuring they have legal rights to upload materials. TeachGenie assumes no liability for copyright infringement by users.
9. Dispute Resolution
- Disputes between students and tutors should be resolved directly between the parties.
- TeachGenie may, but is not obligated to, assist in resolving disputes.
10. Termination
- You may close your account at any time by contacting support.
- TeachGenie may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the platform or other users.
- Right to Terminate: TeachGenie reserves the right to suspend or terminate accounts at any time, with or without cause, with or without notice, for any reason or no reason, including to protect the integrity of the platform and our users.
- Tutor Termination: For tutors, account termination may occur due to factors such as consistently poor service quality, repeatedly failing to respond to students, frequent session cancellations, unprofessional conduct, or other behaviors that negatively impact the user experience. We aim to maintain a high-quality marketplace and reserve the right to remove tutors who do not meet our standards.
- Effects of Termination: Upon termination, your access to the platform will cease. Pending sessions and payments will be handled according to our standard procedures. Some information may be retained as required by law or for legitimate business purposes.
11. Changes to Terms
- TeachGenie may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms.
12. Governing Law
- These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to conflict of law principles.

14. Indemnification
You agree to indemnify, defend, and hold harmless TeachGenie, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Platform; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party.
15. Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, U.S.A., and the language of the arbitration shall be English. You waive any right to a jury trial or to participate in a class action.
16. AI Features & Processing
- AI-Powered Services: TeachGenie offers AI-powered features including exam prediction, content analysis, and personalized recommendations.
- Data Processing: By using AI features, you consent to the processing of your uploaded materials by AI systems for analysis and improvement.
- Model Training: Uploaded materials may be used to improve AI models and enhance platform functionality.
- Data Retention: AI-processed materials are retained for ongoing analysis and model improvement, subject to takedown requests.
- Accuracy Limitations: AI predictions and analysis are estimates based on available data and should not be considered definitive or guaranteed.
- User Responsibility: Users are responsible for the accuracy and legality of materials uploaded for AI processing.
17. Learning Data & Communication Processing
- Communication Services: TeachGenie facilitates communication between tutors and students through messaging and chat features.
- Learning Analysis: Student responses to educational content, assessments, and questions may be analyzed to improve learning outcomes.
- Personalization: Learning patterns and communication data may be used to provide personalized educational recommendations and content.
- Educational Research: Anonymized learning data may be used for educational research and platform enhancement.
- Data Retention: Messages and learning responses are retained for platform functionality, dispute resolution, and educational improvement.
- User Consent: By using communication and learning features, you consent to the processing of your data for these purposes.
18. Copyright & DMCA Policy
TeachGenie respects the intellectual property rights of others and expects users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please notify us at teachgenieai@gmail.com with the following information: (a) a description of the copyrighted work; (b) a description of where the material is located on the Platform; (c) your contact information; (d) a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner; and (e) a statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. TeachGenie will respond to all such notices and take appropriate action, including removing infringing material where required.
Takedown Process: For all content on the platform, TeachGenie will:
- Remove the specific infringing materials as soon as reasonably possible, typically within 2-7 business days of receiving a valid takedown request
- Cease using the materials for any platform functionality, including AI processing and analysis
- Retain anonymized, aggregated data as permitted by law for platform functionality
- Provide confirmation of takedown actions to the copyright owner
Counter-Notification: If you believe your materials were removed in error, you may submit a counter-notification with the same information requirements as above, plus a statement of your good faith belief that the material was removed by mistake or misidentification.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
